These Terms and Conditions ("Terms", "Agreement") govern your access to and use of the ourdream ai website located at https://us-ourdreamai.com/, our mobile applications, APIs, and all related services, features, and content (collectively, the "Services"). The Services are owned and operated by ourdream ai Inc. ("Company," "we," "us," or "our").
By registering for an account, accessing the platform, or otherwise using the Services, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms. If you do not agree with any part of these Terms, you are strictly prohibited from using the Services and must discontinue use immediately.
1. Eligibility and Strict Age Restrictions
ourdream ai is strictly an 18+ platform. The nature of our Generative AI technology allows for unfiltered, unrestricted, and highly explicit mature roleplay scenarios. Because of this baseline functionality, no individual under the age of 18 (or the age of legal majority in your respective jurisdiction, whichever is higher) is permitted to access or use the Services under any circumstances.
By creating an account, you represent and warrant that you are at least 18 years old and that you possess the legal capacity to enter into a binding contract. We reserve the absolute right to request age verification documentation at any time. If we discover or have reasonable grounds to suspect that an account belongs to a minor, we will terminate the account immediately, purge all associated data without notice, and potentially ban the user’s IP address from future access.
2. User Accounts and Account Security
To fully experience ourdream ai, you must register for an account. You are solely responsible for maintaining the confidentiality and security of your account credentials (username, email, and password). You agree to accept responsibility for any and all activities or actions that occur under your account.
You must not share your account credentials with any third party. If you know or suspect that your account has been compromised, you must notify our Support Team immediately. We will not be liable for any loss or damage arising from your failure to adequately secure your account credentials.
3. Subscription Plans, Billing, and Dreamcoins
We offer both a free tier ("Wanderer") and premium subscription tiers (e.g., "Dreamer Pro"). By upgrading to a premium subscription, you agree to pay all applicable fees as displayed at checkout.
- Billing Cycle: Subscriptions are billed in advance on a recurring, periodic basis (monthly or annually, depending on your selection). Your subscription will automatically renew under the exact same conditions unless you cancel it or we cancel it.
- Cancellations: You may cancel your subscription renewal at any time via your Account Settings. Upon cancellation, you will retain access to the premium features until the end of your current paid billing cycle.
- Refund Policy: Due to the high computational costs of Generative AI, all charges are strictly non-refundable. Exceptions may only be made in the event of a severe, prolonged service outage or billing error, at our sole discretion.
- Dreamcoins: "Dreamcoins" are a virtual currency utilized within the platform to generate images, videos, and prolonged voice calls. Dreamcoins have no real-world monetary value, cannot be exchanged for cash, and remain the property of ourdream ai. We reserve the right to modify the cost of generating media in Dreamcoins at any time based on server load and computational costs.
4. Acceptable Use and Content Generation Rules
We pride ourselves on offering an "unfiltered" experience. In the context of textual roleplay with AI, this means we do not utilize restrictive corporate safety filters that prevent NSFW (Not Safe For Work) or mature narrative explorations. However, "unfiltered" does not mean immune from the law. You agree to use the Services only for lawful purposes.
You are strictly prohibited from using the Services to generate, request, upload, or share content that falls into the following categories:
- Child Sexual Abuse Material (CSAM): The generation, attempted generation, or uploading of any material depicting minors in explicit situations is unequivocally banned. We utilize automated hashing and reporting tools and will report violators to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement immediately.
- Non-Consensual Deepfakes: You may not use our image generation tools to create explicit imagery of real, non-consenting individuals (including celebrities, politicians, or private citizens).
- Real-World Harm: You may not use the AI to plan, encourage, or facilitate actual illegal acts, terrorism, self-harm, doxxing, or the harassment of real human beings.
Violation of these Acceptable Use rules will result in immediate account termination without refund and potential legal action.
5. Intellectual Property Rights
Your Content
You retain any intellectual property rights you hold in the original prompts, text, and base images you upload to the platform (e.g., when creating a character in the Creator Studio). By publishing a character to the public hub, you grant ourdream ai a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, display, and distribute that character configuration across our platform and for promotional purposes.
AI-Generated Outputs
The copyright status of AI-generated content is an evolving area of law. To the extent permissible by law, we relinquish all ownership claims to the specific textual responses and images generated for you during your private chat sessions. You may use the outputs generated in your private chats for personal, non-commercial purposes. If you are on a Pro tier, we grant you a broad license to use your generated outputs for commercial purposes, though we cannot guarantee that you can claim formal copyright ownership over AI-generated material in your jurisdiction.
Our Intellectual Property
The platform architecture, proprietary code, brand name, logos, UI/UX designs, and underlying machine learning fine-tunes remain the exclusive property of ourdream ai Inc. You may not copy, reverse engineer, decompile, or otherwise attempt to extract the source code or proprietary models of our Services.
6. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. OURDREAM AI MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THE SERVICES, THE ACCURACY OF THE AI RESPONSES, OR THE UNINTERRUPTED AVAILABILITY OF THE PLATFORM.
Due to the hallucinatory nature of Large Language Models, the AI may generate content that is inaccurate, contradictory, or offensive. You acknowledge that you are conversing with a mathematical algorithm, not a sentient being, and that ourdream ai is not responsible for any emotional distress, misunderstanding, or reliance on information provided by the AI characters.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OURDREAM AI, ITS FOUNDERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) ANY CONTENT OBTAINED FROM THE SERVICES.
In no event shall our total liability to you for all claims arising out of or relating to the use of the Services exceed the amount you paid us, if any, during the past twelve (12) months immediately preceding the claim.
8. Indemnification
You agree to defend, indemnify, and hold harmless ourdream ai and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms; or c) content generated or published by you on the platform.
9. Termination
We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your account, you may simply discontinue using the Services or use the "Delete Account" feature in your dashboard, which will permanently erase your data as outlined in our Privacy Policy.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. Governing Law and Dispute Resolution
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in San Francisco, California, before one arbitrator. Judgment on the award may be entered in any court having jurisdiction. This clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
